Welcome to a new select group of collectors. Please read the following thoroughly so you understand our shipping process and returns policies and specifications.
Summary of Standard Terms and Conditions
The following is a summary of some of the most relevant rules that apply when you order from mimushishop.com. These are not the actual terms and conditions which you will agree to follow and abide by. For the full and detailed version please click here. The following is only a guide and a summary intended to facilitate your understanding.
1. Processing, Delivery and Freight Terms
Orders placed by noon EST are normally processed and shipped within approximately 2-3 business days from the date your order was placed. (Buyer is to take order processing time into account when selecting your shipping method).
2. Delivery Method (within the U.S.)
The Company will arrange for shipment to the Buyer of all Goods to your address using UPS or USPS or any other company that offers a traceable package service. Please be aware that UPS does not service P.O. Box or APO addresses. You are responsible for providing a regular post mail address.
3. International Shipping Methods and Customs Details
Buyers are fully responsible for complying with their country's laws, Customs regulations, taxes, and duties. Company is not responsible for packages delayed or detained in Customs. Company usually, although not required to, shall ship internationally using Airmail Parcel Post (USPS) and UPS Worldwide Express.
4. Shipping Cost
Your shipping charge will vary depending on the weight of your package, size of your order, shipping company, shipping method, shipping address, and any other relevant conditions. You shall bear all costs of shipping the Goods.
5. Free Shipping Promotional Offers
Please be aware that any free shipping offers available on our website apply only to customers shipping within the USA and are shipped by UPS Ground.
6. Cancellations, Changes and Returns of Collectibles
All sales are final. However, all undelivered Goods may be cancelled by Buyer only upon written approval of an authorized representative of Company. No cancellations of orders will be permitted within fewer than 5 days of acknowledged ship date except in the sole and exclusive discretion of the Company and subject to payment of all applicable cancellation charges.
In the event of any cancellation of an order by Buyer, Buyer shall pay to Company its reasonable costs and expenses. Where returned Goods are found to be damaged due to the Buyer's fault the Buyer will be liable for the cost of remedying such damage.
If your return does not meet these conditions, you’ll be charged a 20% re-stocking fee or have your defective merchandise returned to you. It is entirely to Company’s discretion to determine whether the item(s) was (were) damaged due to customer abuse or negligence, and this item(s) will not be accepted or Buyer will be liable for the cost of remedying such damage.
Company will only accept returns for defective items that are received in their original packaging, which means that returned Goods must be of current manufacture, unused, still sealed in its original bag, inside its original box, -including anything else that came with the item, such as blister cards, accessories, and the like, must be included as well-, and must all be in resalable condition, and securely packed, internally and with out-of-the box additional packaging, to reach Company without damage. Company reserves the right to change the price, terms of payment and delivery dates for any Goods affected by any alterations or modification to which it consents. Goods may not be returned prior to the Company's written consent and issuance of a return authorization number (RAN). Authorized returns are subject to a 20% restocking fee, plus any import or export costs and costs associated with transportation, packaging and insurance. Any credit card transaction fees may also be assessed to Buyer at Company’s discretion.
Provided the Goods are in a saleable condition when received by the Company, the Buyer shall receive a refund of all monies paid for the Goods, and shall exclude any other costs including but not limited to costs for shipping, handling, any applicable insurance fees, and any applicable sales taxes, which are costs that you incurred when you bought the Goods, and are not refundable and will be deducted from any refund. Buyer must afford the Company a reasonable opportunity to inspect the Goods in unaltered condition and evaluate the claims in accordance with procedures customary to the industry. The Company may choose to repair, replace, or exchange Goods at its discretion.
Because the items sold on Mimushi are extremely difficult for us to create and/or buy and bring into the United States, we cannot accept returns on non-defective merchandise and can’t issue refunds, credits, or exchanges for a different item. We can only offer customers with defective merchandise the option of a refund or an exchange if the item purchased is still available. All other returns will be handled on a case-by-case basis. 7. Inspection, Rejection and Returns
Buyer agrees to fully inspect all Goods at the time of delivery. In the event that such inspection reveals any damage in the Goods, Buyer shall have the right to reject such Goods and, in such event, shall notify the Company and the carrier immediately of any such damage. Most of the goods that we sell are collectible, made in limited runs and often hand-painted and/or assembled. Slight imperfections are possible with this kind of product. However, if your merchandise has a significant/material defect right after delivery (i.e. the product is broken or missing parts), the Company will issue authorization for the return thereof; provided, however, the Buyer must provide written notice to the Company of any and all claims for shortage, material defect or non-receipt of Goods within ten (10) contiguous days of receipt thereof or invoice therefore. No Goods will be accepted for return and no credit will be allowed on any returned Goods without the prior written authorization of the Company and the return of the Goods in unused, undamaged and otherwise “as new” condition; the good must at all times be in its original sealed transparent bag; do not break/open this bag if you intend to return the good. If Buyer fails to notify the carrier and the Company in writing of any such damage within ten (10) contiguous days of delivery, Buyer shall be deemed to have accepted the Goods delivered. Such acceptance shall constitute an irrevocable acceptance of the Goods by Buyer and a waiver of any and all claims Buyer may otherwise have had against the Company with respect to such Goods. In addition, the Company must be advised of all shortages, in writing, within ten days of receipt of Goods. The Company shall not accept Goods for return after such Goods are accepted by Buyer unless Company consents in writing. Company may withhold such consent for any reason in its sole discretion.
Most of the artwork that we sell is collectible, made in limited runs and often hand-painted and/or assembled. Since Company thoroughly inspects, and carefully and securely packages all artwork before it reaches the shipping company, no artwork can be returned nor refunded.
Your sole remedy concerning the Goods is, in the Company's sole discretion: (i) to replace any defective Goods; or (ii) to refund the amounts paid by you to the Company. In either case, you must first return the Goods in accordance with the Return Policies as set forth herein.
9. To Make a Return
Contact Mimushi by e-mail at sales at mimushi dot com, within ten (10) contiguous days from the date of receipt. Let us know what the problem is, and we’ll give you a Return Authorization Number (RAN). Follow the return instructions provided by our Web Sales staff, use suitable packing materials (please send it back in a shipping box for safety!), and make sure to write your RAN on the outside of your shipping box. Once the return is received you will be contacted via e-mail.
Goods must be returned at the Buyer's cost and should be adequately insured during the return journey, or accept the risk of loss or damage during shipment if sent uninsured. Goods to be returned must clearly show the invoice number and RAN obtained from the Company on the package. Failure to follow the procedures set out in this section may result in delays in the replacement of parts, repair, or replacement of your Goods. In addition, the Company reserves the right to refuse to accept Goods when these procedures are not followed.
Each Goods manufactured and sold by the Company is covered by the applicable limited warranty provided with the Goods. If any Goods covered under warranty is returned by the Buyer in accordance with the Company's return policy within the applicable warranty period, and, upon examination the Company determines to its satisfaction that such Goods was detective due to materials or workmanship within the specified warranty period, the Company will, at its option, repair or replace the Goods or the defective part thereof. The Company may in its sole discretion refund the original purchase price of the Goods to the Buyer. In no event will the Company be responsible for damage to any Goods resulting from accident, neglect, use of the Goods other than in accordance with the applicable user documentation provided with the Goods or resulting from installation, repairs or alterations made by any person or firm not duly authorized by the Company in writing or for problems attributable to other Goods or services not provided by the Company.
